Bundesverfassungsgericht zur Streitwertfestsetzung bei einer einvernehmlichen Scheidung
Das Bundesverfassungsgericht hat in seiner Entscheidung BVerfG, 1 BvR 735/09 vom 12.10.2009, Absatz-Nr. (1 – 20), erneut deutlich gemacht, daß der Amtsrichter bei der Streitwertfestsetzung die gesetzlichen Vorgaben zu berücksichtigen hat und den Streitwert für eine einvernehmliche Scheidung nicht ohne weiteres willkürlich herabsetzen kann.
In Absatz 16 führt es zunächst zur Gesetzeslage aus:
Nach § 48 Abs. 2 Satz 1 GKG a.F. (jetzt § 43 Abs. 1 Satz 1 FamGKG) ist der Streitwert in nichtvermögensrechtlichen Angelegenheiten unter Berücksichtigung aller Umstände des Einzelfalls, insbesondere des Umfangs und der Bedeutung der Sache und der Vermögens- und Einkommensverhältnisse der Parteien, nach Ermessen zu bestimmen; in Ehesachen ist dabei für die Einkommensverhältnisse das im Zeitraum von drei Monaten erzielte Nettoeinkommen der Eheleute einzusetzen (§ 48 Abs. 3 Satz 1 GKG a.F., jetzt § 43 Abs. 2 FamGKG) und ein Streitwert von mindestens 2.000 € zu bestimmen (§ 48 Abs. 3 Satz 2 GKG a.F., jetzt § 43 Abs. 1 Satz 2 FamGKG).
Sodann stellt es fest:
Hiernach bestehen zwar keine verfassungsrechtlichen Bedenken gegen ein Abweichen vom einzusetzenden dreifachen Nettoeinkommen, wenn der Streitwert für eine einverständliche Scheidung (§ 630 a.F. der Zivilprozessordnung) mit deswegen geringem Umfang festzusetzen ist (vgl. BVerfG, Beschluss der 2. Kammer des Ersten Senats vom 17. Dezember 2008 – 1 BvR 177/08 -, NJW 2009, S. 1197). Insbesondere ist es aus verfassungsrechtlicher Sicht nicht zu beanstanden, wenn unter Abwägung aller Umstände mit vertretbarer Begründung angenommen wird, dass eine Festsetzung des Streitwerts auf das dreifache monatliche Nettoeinkommen im konkreten Fall nicht berechtigt ist; der Streitwertbemessung darf es jedoch nicht an einer nachvollziehbaren Grundlage fehlen.
Hiernach sind die angegriffenen Entscheidungen unter keinem Gesichtspunkt vertretbar und damit objektiv willkürlich. (…) Im vorliegenden Fall beläuft sich nicht nur das in drei Monaten erzielte Nettoeinkommen der Eheleute auf über 13.000 €, es ist daneben auch Immobiliarvermögen der Ehefrau vorhanden, das nach § 48 Abs. 2 GKG a.F. ebenfalls zu berücksichtigen ist. Schon angesichts der 13-jährigen Dauer der Ehe und der gemeinsamen Kinder ist die Scheidungssache auch nicht von einer nur unerheblichen Bedeutung. Unter diesen Umständen ist die Festsetzung eines Streitwerts von lediglich 3.000 € auch in Anbetracht einer kurzen Verfahrensdauer und eines nur geringen Umfangs des Scheidungsverfahrens nicht nachvollziehbar und unter keinem denkbaren rechtlichen Aspekt vertretbar.

Hands down, Apple’s app store wins by a mile. It’s a huge selection of all sorts of apps vs a rather sad selection of a handful for Zune. Microsoft has plans, especially in the realm of games, but I’m not sure I’d want to bet on the future if this aspect is important to you. The iPod is a much better choice in that case.

This is getting a bit more subjective, but I much prefer the Zune Marketplace. The interface is colorful, has more flair, and some cool features like ‘Mixview’ that let you quickly see related albums, songs, or other users related to what you’re listening to. Clicking on one of those will center on that item, and another set of “neighbors” will come into view, allowing you to navigate around exploring by similar artists, songs, or users. Speaking of users, the Zune “Social” is also great fun, letting you find others with shared tastes and becoming friends with them. You then can listen to a playlist created based on an amalgamation of what all your friends are listening to, which is also enjoyable. Those concerned with privacy will be relieved to know you can prevent the public from seeing your personal listening habits if you so choose.

So I baught a new Toshiba NB505 Minuscule laptop and I keep endeavoring to change the background picture from the one it came using so I select a picture, I right click, Click on set as background but the background doesnt change! I also tried to visit to Control Panel but i cant find anything of which says change background only Screen saver! Can any one help me.. How am i allowed to change the background photo? Hands down, Apple’s app store wins by a mile. It’s a huge selection of all sorts of apps vs a rather sad selection of a handful for Zune. Microsoft has plans, especially in the realm of games, but I’m not sure I’d want to bet on the future if this aspect is important to you. The iPod is a much better choice in that case.
