Erhöhung Kindergeld und Kindesunterhalt zum 01.01.2010
Der Bundesrat hat dem Wachstumsbeschleunigungsgesetz am 18.12.2009 zugestimmt, wodurch auch § 66 I 1 Bundeskindergeldgesetz geändert wird.
Damit erhöht sich das Kindergeld ab dem 01.01.2010 je Kind um EUR 20,00, d.h., für das erste und zweite Kind wird es statt bisher EUR 164,00 künftig EUR 184,00, für das dritte Kind künftig EUR 190,00 und für jedes weitere Kind künftig je EUR 215,00 geben.
Grundsätzlich verringert sich dadurch künftig für Unterhaltsverpflichtete der Zahlbetrag nach der Düsseldorfer Tabelle, wenn sich nicht zugleich die Unterhaltsbeträge der Düsseldorfer Tabelle wesentlich ändern. Damit ist aber zu rechnen, denn mit dem Wachstumsbeschleunigungsgesetz wird auch das sächliche Existenzminimum für die minderjährigen Kinder angehoben (Anhebung des Kinderfreibetrages). Dieses ist aber nach § 1612a BGB Grundlage für den Mindesunterhalt eines minderjährigen Kindes, d.h., der in der Düsseldorfer Tabelle ausgewiesene Mindestunterhalt erhöht sich ebenfalls als Folge der Gesetzesänderung. Damit wird im Ergebnis ein Unterhaltsverpflichteter ab 01.01.2010 trotz Erhöhung des Kindergeldes nicht weniger sondern tatsächlich mehr Kindesunterhalt bezahlen müssen.
Ob auf Grund dessen die Düsseldorfer Tabelle noch weitere Änderungen erfahren wird, wie z.B. eine diskutierte Anhebung des notwendigen Selbstbehaltes, bleibt abzwarten.
Mit einer baldigen Anpassung der Düsseldorfer Tabelle ist zu rechnen, da diese aber kein Gesetzeswerk ist, liegt diese eventuell erst nach dem 01.01.2010 vor.

Super die Väter werden immer mehr in die Armut getrieben, und denn Müttern geht es immer besser weil die mit dem Kindesunterhalt machen dürfen was sie wollen laut Jugenamt. Somit wird nicht das Kind unterstützt sondern die faulheit der Mutter.Der Vater soll mit einem Selbstbehalt von 900,- teilweise auch mit weniger auskommen, muß davon Miete, Versicherungen u.s.w. bezahlen. Zum beispiel bekommt ein Kind aus der Zweiten Altersgruppe 240,- natürlich jetzt 272,- Kindesunterhalt, dann noch 184,- Kindergeld das sind 456,- zusammen, wo ist denn da die gerechtigkeit. warum muß ein Vater für die Miete von der Exfrau mit aufkommen, Das sollte nicht mit beim Kindesunterhalt reingerechnet werden, den die meisten Mütter können in dem Alter des Kindes Vollzeit arbeiten gehen und selber für die Miete aufkommen, und dann kommt noch dazu das die Mutter ja auch noch Unterstützung vom Staat bekommt wie zum Beispiel Wohngeld und das wird natürlich nicht mit berechnet. Aber immer weiter so kein wunder das die meisten Väter keine lust mehr haben arbeiten zu gehen um ihren Exfrauen das Geld in den Arsch zu schieben. Die meisten Familien haben nicht so viel Geld für ihre Kinder im Monat über, und können auch nicht so viel ausgeben. Während der Ehe mußte der Vater ja auch nur einmal Miete bezahlen und nicht zweimal, die Väter werden nur noch abgezockt. Meistens sorgen die Mütter dafür das die Ehe kaputt geht und die Väter müßen trotzdem zahlen. Ich kenne Exfrauen denen geht es finanziell jetzt viel besser, und natürlich weil die Väter ihren lebensstandart finanzieren müßen und die Kinder nicht viel von dem Geld haben. Der nächste Slogan vom Staat müßte denn so heißen “Die Väter in armut bringen damit die Mütter super leben können”. Die Väter müßten mehr über das Geld für die Kinder verfügen, und die Mutter müßte Quittungen und so weiter vorlegen um das Geld vom Vater zu fordern, fürs essen reicht das Kindergeld.Wenn man so weiter mit den Vätern umgeht werden es bald keine Kinder mehr geben, weil die Väter angst davor haben in armut zu geraten. Macht weiter so, dann gibt es bald keine Kinder mehr. Das erste KInd geht vor die neue Familie, das darf nicht sein da kann man dann von Kinderarmut sprechen, denn das erste Kind wird vom Staat geschützt, die neue Familie nicht. Da viele Frauen das problem haben Kinder zu bekommen, müßen sie sich hilfe suchen, das heißt künstliche Befruchtung bei vielen, da das aber viel geld kostet und der Staat das auch nicht unterstützt können sich das viele Paare auch nicht leisten vor allem wenn der Partner auch noch so viel Kindesunterhalt bezahlen muß. Für die Abwrackprämie hatte der Staat Geld über, aber nicht für künstliche Befruchtung oder für die Unterstützung der Väter. Vielleicht sollte es nur noch maschinen geben und keine Menschen mehr.

Ich bin selbst betroffen. Meine Ex kümmert sich sehr um die Kinder. D.h. angemessene Hilfe bei den Schulaufgaben, Wohnung i.o. soziale Kontakte o.k. was halt so möglich ist. Leider wollen die Kinder “jetzt” keinen Kontakt zu mir. Das ist eine sehr unschöne aber leider bekannte Folge der Trennung. Würde aber zu weit führen. Sie bekommt Hartz IV und den Rest von mir. Nunmehr insgesamt 606€. Was mich am meisten Ärgert ist, dass das Geld nicht bei den Kindern ankommt. Denn ihr wird der die Differenz vom “Staatlichen Unterhalt” abgezogen. Für mich bedeutet dass eine miese Abzocke. Mir bleibt etwas mehr als der Selbstbehalt. Ich kann nun so gut wie gar nichts mehr “Ansparen” um ein paar Geschenke oder sonstiges zu besorgen. Der Staat spart bei den Vätern um es für Erhöhung des Kindergeld wieder auszugeben. Warum werde ich in die Steuerklasse für Singel eingruppiert wenn ich weiterhin die Kosten einer Familie bestreiten muss? Bin aber gebranntmarkt als – Geschieden – . Werde dann noch vom Staat genötigt einen 2.Job anzunehmen damit ich noch weniger Möglichkeiten habe mich irgendwie um die Kinder zu bemühen. Es wird dadurch fast unmöglich den Alltag zu bewältigen.

- Meine Wohnung liegt 60 km von den Kindern entfernt. Wg.

- Von der Psychischen Belastung was Trennung,
Gewohnheitsrecht, Mitsprache, Liebesentzug usw. kaum zu
reden.
So langsam kommt mir der Staat mir den Familien gegenüber A – Sozial vor.
Natürlich ist so eine Regierung zu führen nicht leicht. Aber wenn die Basis wegbricht…

..beim erwerbstätigen Unterhaltspflichtigen monatlich 900 EUR. Hierin sind bis 360 EUR für Unterkunft einschließlich umlagefähiger Nebenkosten und Heizung (Warmmiete) enthalten…!

Ja, richtig, der genannte Betrag ist der sogenannte notwendige Selbstbehalt bei Unterhaltsverpflichtung eines Erwerbstätigen gegenüber minderjährigen Kindern. Die neue Düsseldorfer Tabelle liegt im Text vor: Düsseldorfer Tabelle (Stand 01.01.2010)
Am Dienstag, den 09.02.2010 wird das Bundesverfassungsgericht zu Hartz 4 eine Entscheidung verkünden. Diese Entscheidung kann auch Auswirkungen auf die Düsseldorfer Tabelle und die Höhe der Selbstbehalte haben, vergleiche auch Archiv Düsseldorfer Tabelle, dort Eintrag vom 25.01.2010

Ich habe heute eine Entscheidung getroffen. Ich werde meine Kinder ncht mehr sehen. Ich habe keine Kraft mehr. Ich habe jetzt über 10 Jahre alles getan um ein guter Vater zu sein. Ich kann aber kein Geld scheissen. Diese 800 € sind soviel das ich nichts mehr übrig habe um meinen Töchter am Woende etwas zu bieten. Das wars dann halt. Wo ist denn hier mal Aufstand?

Bei allem Respekt, das wäre keine gute Entscheidung, die Kinder können für diese Situation am wenigsten und können insbesondere auch nichts zu einer Änderung der Situation beitragen. Ich weiß nicht, von welchen EUR 800,00 Sie sprechen, aber eventuell ist es sinnvoll, mal Ihre Leistungsfähigkeit durch einen Rechtsanwalt prüfen zu lassen. Grob gesagt haben Ihnen (bei minderjährigen Kindern) als nicht erwerbstätiger Unterhaltspflichtiger monatlich 770 EUR, als erwerbstätiger Unterhaltspflichtiger monatlich 900 EUR als notwendiger Selbstbehalt zu verbleiben. In diesen Beträgen sind Wohnkosten von EUR 360,00 einschließlich umlagefähiger Nebenkosten und Heizung eingerechnet. Liegen die Wohnkosten höher, ist zu prüfen, ob der Selbstbehalt deshalb nach oben anzupassen ist.

Ich bin durch Zufall auf diese Webseite von Ihnen gestoßen. Beim Stöbern auf der Suche nach dem Selbstbehalt 2010.
Nach den unzähligen Schreiben und Forderungen der Gegenseite frage ich mich doch schon langsam ob ich im falschen Film bin. Ob sich arbeiten lohnt. Nach welchen Gesichtspunkten diese Sätze festgelegt werden.
Ich verdiene mit Weihnachts und Urlaubsgeld so ca. 3000€. Ausgezogen bin ich mehr oder weniger mit einem Koffer und ein paar Kleidungsstücken aus dem gemeinsamen Haus. Das vor ca. 3 Jahren.
Nach der neuen Tabelle muß ich jetzt für 3 Kinder 1000€ Kindesunterhalt bezahlen. Ab August werden es noch mal 50-60€ mehr. Dann zahle ich noch zusätzlich 500€ Kredit fürs Haus ab. In dem wohnt sie mit den Kindern. Hinzu kommen noch mal 236€ für einen Kredit den ich mir vor 2 Jahren genommen habe um mir ein paar Möbel und einen neuen Hausstand anzuschaffen. Tja und ich war noch so blöd ihr 2000€ vor 2 Jahren von dem genommenen Kredit zu geben um Heizöl fürs Haus zu kaufen. Hinzu kommen noch 103€ für eine Risterrente. Verbleiben mir also so knapp 1160€.
Davon zahle ich knapp 500€ Warmmiete für meine 2 Zimmer Wohnung. Laut der Düsseldorfer Tabelle stehen mir hier gerade mal 360€ zu Verfügung. Ich frage mich woher die ihre Mietpreise her haben. Für 360€ Warmmiete bekomme ich hier wenns hochkommt gerade mal eine Abstellkammer. Wenn meine Kinder bei mir sind und das sind sie noch alle 2 Wochenenden. Ich frag mich wie lange noch. 4 Personen am Wochenende auf 40m².
Meine Ex verdient ca. 1500€ dann 1000€ Kindesunterhalt. Zusätzlich Kindergeld 554€. Tja und dann wohnt sie in mit den Kindern im gemeinsamen Haus mit 170m². Der Freund wohnt im Haus hat sich dort nicht angemeldet und hat seinen Wohnsitz brav bei seinen Eltern gemeldet.
Wenn ich was von ihr will, muß ich klagen. Die Kosten trage ich. Sie klagt und wer zahlt das? Endweder ich oder es läuft per Verfahrenskostenhilfe.
Tja was bringt das Wachstumsbeschleunigungsgesetz mir????
Nichts außer noch mehr zu zahlen.
Ich habe 3 wunderbare Kinder die ich nicht vermissen möchte. Mit dem Wissen heute hätte ich maximal 1 Kind gewollt.

auf Grund der mitgeteilten Zahlen habe ich Ihren Namen anonymisiert.
In Ihrem Fall kann eine Überprüfung der Unterhaltsberechnung sinnvoll sein. Die neue Düsseldorfer Tabelle stellt bei den Unterhaltssätzen nunmehr auf 2 Unterhaltspflichtige ab, (früher drei), d.h., bei einem etwaigen vorliegenden dynamischen Titel dürften Sie (bei ansonsten unveränderten Parametern) ab 01.01.2010 zu hoch eingestuft sein. Ist das der Fall, müßte ein Abänderungsverfahren eingeleitet werden. Dabei sollte auch geprüft werden, ob die Kosten für den Hauskredit weiterhin alleine von Ihnen zu zahlen sind.
Anhand der von Ihnen mitgeteilten Zahlen dürfte für ein Abänderungsverfahren auch für Sie Verfahrenskostenhilfe in Frage kommen.

habe zwei Kinder 10 Monate und 4 Jahre. Verdiene hier in Sachsen-Anhalt 780Euro netto 9 Stunden am Tag und 5 Tage die Woche. Und soll jetzt 440euro Unterhalt zahlen! Wie soll das denn gehen? Kann mich das jugendamt dazu zwingen hier weg zu ziehn?
Wenn meine Ex Unterhaltsvorschuß beantragt was ist wenn ich in 6 jahren immer noch unter meinen Selbstbehalt bin??

Hallo, ich habe 2 Kinder, 9 u. 12 Jahre alt. Bin jetzt geschieden und natürlich unterhaltspflichtig. Obwohl ich eine Vollzeit-Umschulung mache und für diese Zeit (2 Jahre), Übergangsgeld erhalte, werde ich als nicht erwerbstätig eingestuft und darf damit nur 770.-€ behalten. Ist das korrekt so? wie sieht es denn aus wenn der unterhaltspflichtige eine neue partnerin hat die aber auch unterhaltspflichtig ist gegenüber 2 minderjährigen kids?beiden bleibt jeweils 900euro.
er bezahlt schon unterhalt ans jugendamt und zwar alles was über 900euro ist.kann dann noch eine lohnpfändung erhoben werden?

This is getting a bit more subjective, but I much prefer the Zune Marketplace. The interface is colorful, has more flair, and some cool features like ‘Mixview’ that let you quickly see related albums, songs, or other users related to what you’re listening to. Clicking on one of those will center on that item, and another set of “neighbors” will come into view, allowing you to navigate around exploring by similar artists, songs, or users. Speaking of users, the Zune “Social” is also great fun, letting you find others with shared tastes and becoming friends with them. You then can listen to a playlist created based on an amalgamation of what all your friends are listening to, which is also enjoyable. Those concerned with privacy will be relieved to know you can prevent the public from seeing your personal listening habits if you so choose.

Apple now has Rhapsody as an app, which is a great start, but it is currently hampered by the inability to store locally on your iPod, and has a dismal 64kbps bit rate. If this changes, then it will somewhat negate this advantage for the Zune, but the 10 songs per month will still be a big plus in Zune Pass’ favor.
