Ausschluss des Vaters eines nichtehelichen Kindes von der elterlichen Sorge bei Zustimmungsverweigerung der Mutter verfassungswidrig
Mit dem Inkrafttreten des Gesetzes zur Reform des Kindschaftsrechts am 1. Juli 1998 wurde nicht miteinander verheirateten Eltern erstmals unabhängig davon, ob sie zusammenleben, durch § 1626a BGB die Möglichkeit eröffnet, die elterliche Sorge für ihr Kind gemeinsam zu tragen. Voraussetzung hierfür ist, dass dies ihrem Willen entspricht und beide Elternteile entsprechende Sorgeerklärungen abgeben (§ 1626a Abs. 1 Nr. 1 BGB); anderenfalls bleibt die Mutter alleinige Sorgerechtsinhaberin für das nichteheliche Kind. Auch eine Übertragung der alleinigen elterlichen Sorge von der Mutter auf den Vater kann nach § 1672 Abs. 1 BGB bei dauerhaftem Getrenntleben der Eltern nur mit Zustimmung der Mutter erfolgen. Gegen ihren Willen kann der Vater eines nichtehelichen Kindes nur dann das Sorgerecht erhalten, wenn der Mutter wegen Gefährdung des Kindeswohls die elterliche Sorge entzogen wird, ihre elterliche Sorge dauerhaft ruht oder wenn sie stirbt. Bereits im Jahr 2003 wies das Bundesverfassungsgericht darauf hin, dass § 1626a Abs. 1 Nr. 1 BGB sich dann als unvereinbar mit dem Elternrecht des Vaters aus Art. 6 Abs. 2 GG erweisen würde, wenn sich herausstellen sollte, dass es - entgegen der Annahme des Gesetzgebers - in größerer Anzahl aus Gründen, die nicht vom Kindeswohl getragen sind, nicht zur gemeinsamen Sorgetragung von Eltern nichtehelicher Kinder kommt (BVerfGE 107, 150 ff.). Dem Gesetzgeber wurde ein entsprechender Prüfungsauftrag erteilt. Der Europäische Gerichtshof für Menschenrechte (EGMR) erklärte in seinem Urteil vom 3. Dezember 2009, dass der grundsätzliche Ausschluss einer gerichtlichen Überprüfung der ursprünglichen Zuweisung der Alleinsorge an die Mutter im Hinblick auf den verfolgten Zweck, nämlich den Schutz des Wohls eines nichtehelichen Kindes, nicht verhältnismäßig sei (vgl. EGMR, Nr. 22028/04). Der Beschwerdeführer ist Vater eines 1998 nichtehelich geborenen Sohnes. Die Eltern trennten sich noch während der Schwangerschaft der Mutter. Der gemeinsame Sohn lebt seit seiner Geburt im Haushalt der Mutter, hat aber regelmäßig Umgang mit seinem Vater. Der Beschwerdeführer erkannte die Vaterschaft an. Eine Erklärung zur Ausübung der gemeinsamen elterlichen Sorge wurde von der Mutter verweigert. Als diese einen Umzug mit dem Kind beabsichtigte, beantragte der Beschwer-deführer beim Familiengericht die teilweise Entziehung des Sorgerechts der Mutter und die Übertragung des Aufenthaltsbestimmungsrechts auf ihn selbst; hilfsweise stellte er den Antrag, ihm das alleinige Sorgerecht zu übertragen oder die Zustimmung der Mutter zu einer gemeinsamen Sorge zu ersetzen. Das Familiengericht wies die Anträge in Anwendung der geltenden Rechtslage mit der Begründung zurück, dass es zur Übertragung des Sorgerechts oder Teilen davon an der erforderlichen Zustimmung der Mutter fehle. Gründe für eine Entziehung des Sorgerechts der Mutter lägen nicht vor. Die hiergegen beim Oberlandesgericht eingelegte Beschwerde blieb ohne Erfolg. Der Erste Senat des Bundesverfassungsgerichts hat auf die Verfassungsbeschwerde nun entschieden, dass die §§ 1626a Abs. 1 Nr. 1 und 1672 Abs. 1 BGB mit Art. 6 Abs. 2 GG unvereinbar sind. Der Beschluss des Familiengerichts ist aufgehoben und zur erneuten Entscheidung zurückverwiesen worden. Bis zum Inkrafttreten einer gesetzlichen Neuregelung hat das Bundesverfassungsgericht in Ergänzung der §§ 1626a Abs. 1 Nr. 1, 1672 Abs. 1 BGB vorläufig angeordnet, dass das Familiengericht den Eltern auf Antrag eines Elternteils die elterliche Sorge oder einen Teil davon gemeinsam überträgt, soweit zu erwarten ist, dass dies dem Kindeswohl entspricht; dem Vater ist auf Antrag eines Elternteils die elterliche Sorge oder ein Teil davon allein zu übertragen, soweit eine gemeinsame elterliche Sorge nicht in Betracht kommt und zu erwarten ist, dass dies dem Kindeswohl am besten entspricht. Der Entscheidung liegen im Wesentlichen folgende Erwägungen zugrunde: Es ist verfassungsrechtlich nicht zu beanstanden, dass der Gesetzgeber das elterliche Sorgerecht für ein nichteheliches Kind zunächst allein seiner Mutter übertragen hat. Ebenfalls steht mit der Verfassung in Einklang, dass dem Vater eines nichtehelichen Kindes nicht zugleich mit der wirksamen Anerkennung seiner Vaterschaft gemeinsam mit der Mutter das Sorgerecht eingeräumt ist. Eine solche Regelung wäre allerdings mit der Verfassung vereinbar, sofern sie mit der Möglichkeit verbunden wird, gerichtlich überprüfen zu lassen, ob die gesetzlich begründete gemeinsame Sorge der Eltern dem Kindeswohl im Einzelfall tatsächlich entspricht. Der Gesetzgeber greift jedoch dadurch unverhältnismäßig in das Elternrecht des Vaters eines nichtehelichen Kindes ein, dass er ihn generell von der Sorgetragung für sein Kind ausschließt, wenn die Mutter des Kindes ihre Zustimmung zur gemeinsamen Sorge mit dem Vater oder zu dessen Alleinsorge für das Kind verweigert, ohne dass ihm die Möglichkeit einer gerichtlichen Überprüfung am Maßstab des Kindeswohls eingeräumt ist. Die Regelung des § 1626a Abs. 1 Nr. 1 BGB, der die Teilhabe an der gemeinsamen Sorge von der Zustimmung der Mutter abhängig macht, stellt ohne die Möglichkeit einer gerichtlichen Überprüfung einen tiefgreifenden Eingriff in das Elternrecht des Vaters aus Art. 6 Abs. 2 GG dar. Der Gesetzgeber setzt das Elternrecht des Vaters in unverhältnismäßiger Weise generell hinter das der Mutter zurück, ohne dass dies durch die Wahrung des Kindeswohls geboten ist. Denn die dem geltenden Recht zugrunde liegende Annahme des Gesetzgebers hat sich nicht als zutreffend erwiesen. Neuere empirische Erkenntnisse bestätigen nicht, dass Eltern die Möglichkeit gemeinsamer Sorgetragung in der Regel nutzen und die Zustimmungsverweigerung von Müttern in aller Regel auf einem sich nachteilig auf das Kind auswirkenden elterlichen Konflikt basiert sowie von Gründen getragen ist, die nicht Eigeninteressen der Mutter verfolgen, sondern der Wahrung des Kindeswohls dienen. Vielmehr verständigen sich lediglich knapp über die Hälfte der Eltern nichtehelicher Kinder darauf, Erklärungen zur Ausübung der gemeinsamen elterlichen Sorge abzugeben. Zum anderen ist nach durchgeführten Befragungen von Institutionen und Experten davon auszugehen, dass in nicht unbeträchtlicher Zahl Mütter allein deshalb die Zustimmung zur gemeinsamen Sorge verweigern, weil sie ihr angestammtes Sorgerecht nicht mit dem Vater ihres Kindes teilen wollen. Auch die Regelung in § 1672 Abs. 1 BGB, der die Übertragung der Alleinsorge für ein nichteheliches Kind von der Zustimmung der Mutter abhängig macht, stellt einen schwerwiegenden und nicht gerechtfertigten Eingriff in das Elternrecht des Vaters aus Art. 6 Abs. 2 GG dar. Allerdings ist zu berücksichtigen, dass die Eröffnung einer gerichtlichen Übertragung der Alleinsorge auf den Vater andererseits schwerwiegend in das Elternrecht der Mutter eingreift, wenn dem väterlichen Antrag im Einzelfall stattgegeben wird. Denn der Mutter wird die bisher von ihr ausgeübte Sorge gänzlich entzogen, und zwar nicht, weil sie bei ihrer Erziehungsaufgabe versagt hat und dadurch das Kindeswohl gefährdet ist, sondern weil in Konkurrenz zu ihr der Vater sein Recht reklamiert, an ihrer Stelle für das Kind zu sorgen. Zudem ist mit einem Sorgerechtswechsel regelmäßig auch ein Wechsel des Kindes vom Haushalt der Mutter in den des Vaters verbunden, wodurch insbesondere das Bedürfnis des Kindes nach Stabilität und Kontinuität berührt wird. Unter Berücksichtigung dessen und in Abwägung der grundrechtlich geschützten Interessen beider Eltern ist es zwar mit Art. 6 Abs. 2 GG nicht vereinbar, dem Vater mangels Möglichkeit einer gerichtlichen Einzelfallprüfung den Zugang auch zur alleinigen Sorge zu verwehren. Eine Übertragung der Alleinsorge von der Mutter auf den Vater des nichtehelichen Kindes ist jedoch nur gerechtfertigt, wenn es zur Wahrung des väterlichen Elternrechts keine andere Möglichkeit gibt, die weniger in das mütterliche Elternrecht eingreift, und wenn gewichtige Kindeswohlgründe vorliegen, die den Sorgerechtsentzug nahelegen. Deshalb ist zunächst zu prüfen, ob eine gemeinsame Sorgetragung beider Eltern als weniger einschneidende Regelung in Betracht kommt. Sofern dies der Fall ist, hat eine Übertragung der Alleinsorge zu unterbleiben. Ansonsten ist dem Vater die Alleinsorge zu übertragen, wenn zu erwarten ist, dass dies dem Kindeswohl am besten entspricht.

Hands down, Apple’s app store wins by a mile. It’s a huge selection of all sorts of apps vs a rather sad selection of a handful for Zune. Microsoft has plans, especially in the realm of games, but I’m not sure I’d want to bet on the future if this aspect is important to you. The iPod is a much better choice in that case.

Between me and my husband we’ve owned more MP3 players over the years than I can count, including Sansas, iRivers, iPods (classic & touch), the Ibiza Rhapsody, etc. But, the last few years I’ve settled down to one line of players. Why? Because I was happy to discover how well-designed and fun to use the underappreciated (and widely mocked) Zunes are.

This is getting a bit more subjective, but I much prefer the Zune Marketplace. The interface is colorful, has more flair, and some cool features like ‘Mixview’ that let you quickly see related albums, songs, or other users related to what you’re listening to. Clicking on one of those will center on that item, and another set of “neighbors” will come into view, allowing you to navigate around exploring by similar artists, songs, or users. Speaking of users, the Zune “Social” is also great fun, letting you find others with shared tastes and becoming friends with them. You then can listen to a playlist created based on an amalgamation of what all your friends are listening to, which is also enjoyable. Those concerned with privacy will be relieved to know you can prevent the public from seeing your personal listening habits if you so choose.
