OLG Koblenz | Regelung der elterlichen Sorge bei beabsichtigter Übersiedlung eines Elternteils ins Ausland
-Oberlandesgericht Koblenz lehnt Sorgerechtsantrag der Kindesmutter ab-
Beantragt ein Elternteil das alleinige Sorgerecht, um mit dem gemeinsamen Kind ins Ausland (hier: Italien) überzusiedeln und wird hierdurch das Umgangsrecht des anderen Elternteils beeinträchtigt, müssen triftige Gründe für den Wegzug bestehen, die schwerer wiegen als das Umgangsrecht des Kindes und des anderen Elternteils. Das hat das Oberlandesgericht Koblenz kürzlich in einem Sorgerechtsverfahren verneint.
Die Antragstellerin, die italienische Staatsangehörige ist, und der Antragsgegner sind miteinander verheiratet, leben jedoch in Trennung. Sie haben ein sechs Jahre altes Kind, das bei der Kindesmutter lebt. Die elterliche Sorge steht den Kindeseltern gemeinsam zu. Der Umgang des Kindesvaters mit dem Kind wurde in der Vergangenheit dadurch erschwert, dass es zwischen den Kindeseltern sowie zwischen dem Kindesvater und seinen Schwiegereltern zu Auseinandersetzungen kam. Die Kindesmutter beabsichtigt, mit dem Kind zu ihrem neuen Lebensgefährten nach Italien in die Provinz Salerno umzuziehen. Sie hat deshalb die Übertragung des alleinigen elterlichen Sorgerechts auf sich beantragt.
Das Familiengericht hat den Antrag zurückgewiesen. Die Antragstellerin hat gegen diese Entscheidung Beschwerde eingelegt. Der 11. Zivilsenat – 3. Senat für Familiensachen – des Oberlandesgerichts Koblenz hat die Kindeseltern, das Kind und den für das gerichtliche Verfahren bestellten Verfahrenspfleger des Kindes angehört. Durch Beschluss vom 4. Mai 2010 hat der Familiensenat die Beschwerde der Kindesmutter zurückgewiesen.
Der Senat hat in seinem Beschluss ausgeführt, dass nach § 1671 Abs. 1, Abs. 2 Nr. 2 BGB (im Anhang abgedruckt) nach der Trennung die elterliche Sorge auf Antrag ganz oder teilweise einem Elternteil allein zu übertragen ist, wenn zu erwarten ist, dass die Aufhebung der gemeinsamen Sorge oder eines Teilbereichs sowie die Übertragung auf einen Elternteil dem Wohl des Kindes am besten entspricht. In Fällen des beabsichtigten Umzugs ins Ausland mit dem gemeinsamen Kind seien das Grundrecht des umzugswilligen Elternteils auf örtliche freizügige Lebensgestaltung und das Grundrecht des anderen Elternteils auf möglichst freien Umgang mit seinem Kind abzuwägen und zu einem Ausgleich zu bringen.
Entscheidend sei darauf abzustellen, was dem Kindeswohl am besten diene. Deshalb komme die Übertragung des alleinigen Sorgerechts nur in Betracht, wenn triftige Gründe für den Wegzug bestehen, die schwerer wiegen als das Umgangsinteresse des Kindes und des anderen Elternteils. Im vorliegenden Fall sei zu erwarten, dass es nach einem Umzug der Kindesmutter mit dem Kind nach Italien zu keinem Umgang mit dem Vater mehr kommen werde. Triftige persönliche, familiäre oder berufliche Gründe für eine Übersiedlung habe die Antragstellerin nicht überzeugend dargelegt. Sie verfüge in der Provinz Salerno, die nicht ihre Heimat, sondern die ihres neuen Lebensgefährten sei, über keinerlei gefestigte soziale Bindungen, in die ihr Kind einbezogen sei. Bei der Beziehung zu ihrem neuen Lebensgefährten handele es sich bisher im Wesentlichen um eine Fernbeziehung. Auch konkrete berufliche Perspektiven in Italien habe die Antragstellerin nicht aufzeigen können. Im Rahmen ihrer Anhörung vor dem Senat habe sie vielmehr den Eindruck erweckt, dass vorrangiges Ziel ihrer Übersiedlung nach Italien sei, den Umgang des Kindes mit seinem Vater zu vereiteln.
Unter diesen Umständen müsse die örtliche Freizügigkeit, die die Antragstellerin genieße, im Hinblick auf das Kindeswohl hinter das Umgangsrecht des Antragsgegners zurücktreten. Der Senat hat es auch abgelehnt, lediglich das Aufenthaltsbestimmungsrecht (bei Belassung der gemeinsamen elterlichen Sorge) auf die Kindesmutter zu übertragen. Auch dies entspreche nicht dem Kindeswohl, weil aufgrund des bisherigen Verhaltens der Kindesmutter das Umgangsrecht des Vaters bei einem Umzug als sicher ausgeschlossen anzusehen sei.
