Urteil des Bundesverfassungsgericht vom 09.02.2010 zu Hartz IV (Hartz 4) ohne Auswirkung auf die Düsseldorfer Tabelle 2010
Das Urteil des Bundesverfassungsgericht vom 9. Februar 2010 – 1 BvL 1/09, 1 BvL 3/09, 1 BvL 4/09 – zu Hartz IV ist heute (09.02.2010) verkündet und zugleich vollständig veröffentlicht worden. Dieses hat wider Erwarten zunächst keine Auswirkungen auf die aktuelle Düsseldorfer Tabelle 2010 (Stand 01.01.2010).
Die Leitsätze lauten:

- 1 BvL 1/09 -
- 1 BvL 3/09 -
- 1 BvL 4/09 -
- Das Grundrecht auf Gewährleistung eines menschenwürdigen Existenzminimums aus Art. 1 Abs. 1 GG in Verbindung mit dem Sozialstaatsprinzip des Art. 20 Abs. 1 GG sichert jedem Hilfebedürftigen diejenigen materiellen Voraussetzungen zu, die für seine physische Existenz und für ein Mindestmaß an Teilhabe am gesellschaftlichen, kulturellen und politischen Leben unerlässlich sind.

Dieses Grundrecht aus Art. 1 Abs. 1 GG hat als Gewährleistungsrecht in seiner Verbindung mit Art. 20 Abs. 1 GG neben dem absolut wirkenden Anspruch aus Art. 1 Abs. 1 GG auf Achtung der Würde jedes Einzelnen eigenständige Bedeutung. Es ist dem Grunde nach unverfügbar und muss eingelöst werden, bedarf aber der Konkretisierung und stetigen Aktualisierung durch den Gesetzgeber, der die zu erbringenden Leistungen an dem jeweiligen Entwicklungsstand des Gemeinwesens und den bestehenden Lebensbedingungen auszurichten hat. Dabei steht ihm ein Gestaltungsspielraum zu.

Zur Ermittlung des Anspruchumfangs hat der Gesetzgeber alle existenznotwendigen Aufwendungen in einem transparenten und sachgerechten Verfahren realitätsgerecht sowie nachvollziehbar auf der Grundlage verlässlicher Zahlen und schlüssiger Berechnungsverfahren zu bemessen.

Der Gesetzgeber kann den typischen Bedarf zur Sicherung des menschenwürdigen Existenzminimums durch einen monatlichen Festbetrag decken, muss aber für einen darüber hinausgehenden unabweisbaren, laufenden, nicht nur einmaligen, besonderen Bedarf einen zusätzlichen Leistungsanspruch einräumen.

Hervorzuheben ist meines Erachtens unter unterhaltsrechtlichen Gesichtspunkten (Düsseldorfer Tabelle):
- Die derzeitigen Vorschriften über die Höhe der Regelleistung sind wegen eines Strukturfehlers bei der Ermittlung der Bedarfssätze verfassungswidrig.
- Die derzeit geltenden Bedarfssätze sind nicht evident unzureichend.
- Die bisherige Rechtslage bleibt zunächst weitgehend (Ausnahme siehe 4.) aufrecht erhalten, der Gesetzgeber ist jedoch gefordert, bis 31.12.2010 abzuhelfen.
- Hinsichtlich der im Sozialgesetzbuch Zweites Buch gegenwärtig fehlenden Härtefallklausel zur Deckung besonderen Bedarfs führt die gegenwärtige Rechtslage bei besonderem Bedarf dazu, dass ein solcher auch dann ungedeckt bleibt, wenn er von der verfassungsrechtlichen Garantie eines menschenwürdigen Existenzminimums umfasst ist. Um die Gefahr einer Verletzung von Art. 1 Abs. 1 GG in Verbindung mit Art. 20 Abs. 1 GG in der Übergangszeit bis zur Einführung einer entsprechenden Härtefallklausel zu vermeiden, wird die verfassungswidrige Lücke für die Zeit ab der Verkündung des Urteils durch eine entsprechende Anordnung des Bundesverfassungsgerichts geschlossen.
Daraus folgt, daß die aktuelle Düsseldorfer Tabelle 2010 (Stand 01.01.2010) entgegen ursprünglicher Annahmen derzeit nicht alleine auf Grund der Entscheidung des Bundesverfassungsgerichts anzupassen ist, weil die derzeit geltenden Regelsätze (und damit der in der Düsseldorfer Tabelle zu Grunde gelegte Mindestunterhalt) nicht evident unzureichend ist. Insbesondere die vom Verfassungsgericht geforderten Korrektur- und Anpassungsmöglichkeiten bei besonderem Bedarf sind in den Anmerkungen zur Düsseldorfer Tabelle bzw. diese ersetzenden unterhaltsrechtlichen Leitlinien bereits seit Jahren enthalten. Eine Anpassung wird aber erforderlich, wenn der neu zu ermittelte Bedarf über dem der Düsseldorfer Tabelle zu Grunde gelegten Mindestbedarf liegen sollte.
Aussagen zu Auswirkungen für Empfänger von Hartz IV bitte ich bei Kollegen zu suchen, die auf Sozialrecht spezialisiert sind.

The decision would almost seem obvious except I see the worthiness of having something smaller desires to be easier to have around (especially since I’ll be carrying out a fair bit of camping this summer)…. but but the 620 would you have to be rugged but when I do effortlessly find the E-5 I’d have for you to big slr bodies. What can you do? (avoiding the ‘I would by something in addition to olympus).

Hands down, Apple’s app store wins by a mile. It’s a huge selection of all sorts of apps vs a rather sad selection of a handful for Zune. Microsoft has plans, especially in the realm of games, but I’m not sure I’d want to bet on the future if this aspect is important to you. The iPod is a much better choice in that case.
