Vorteile und Nachteile einer “Scheidung Online” bzw. “Onlinescheidung”?
“Scheidung Online” oder “Onlinescheidung” und “Internetscheidung” sind Begriffe, die immer mehr die Runde machen, weshalb hier kurz auf diese “neue Art der Scheidung” und deren vermeintlichen Vorteile eingegangen wird und Nachteile nicht unerwähnt bleiben sollen.
Was ist unter “Scheidung Online” oder “Onlinescheidung” zu verstehen?
Die Bezeichnung ist falsch, denn es gibt keine “Scheidung Online” oder “Onlinescheidung” oder die Möglichkeit, seinen Scheidungsantrag selbst online bei Gericht einreichen zu können. Mit einer “Onlinescheidung” ist nur das Angebot einer Anwaltskanzlei gemeint, den Kontakt zwischen Mandant und Anwalt, die Beauftragung, Fragen und Anworten online, also gänzlich unpersönlich, abzuwickeln. Das Scheidungsverfahren wird dann ganz herkömmlich von dem Anwalt anhand der übermittelten Daten durch Einreichung eines Antrages auf Ehescheidung beim zuständigen Gericht eingeleitet, so wie das für jedes Verfahren einer Scheidung gesetzlich vorgesehen ist. Das Scheidungsverfahren setzt nach wie vor auch eine persönliche Anhörung der Parteien durch das Gericht voraus, bevor dieses die Scheidung ausspricht.
Für wen kommt eine “Scheidung Online” in Frage?
Eine Onlinescheidung wird propagiert für vermeintlich besonders einfach gelagerte Fälle, deren Bearbeitung online möglich ist. Das sind Konstellationen für eine Scheidung, bei denen ein Ehegatten die Scheidung nach ausreichender Trennungszeit einreichen lassen möchte und der andere Ehegatte diesem Scheidungsantrag zustimmen wird und über weitere Punkte wie z.B. Umgang, Sorgerecht, Kindesunterhalt, nachehelicher Unterhalt, die eheliche Wohnung und den Hausrat und etwaige Ansprüche auf Zugewinn ebenfalls Einigkeit besteht und auch bis zum Termin zur Scheidung vor dem Amtsgericht bestehen bleibt. Dabei kann – genauso wie bei einer normalen Beauftragung – nur eine Partei den Anwalt beauftragen, der Anwalt also auch nur eine Partei vertreten, die andere Partei bleibt in der Regel ohne anwaltliche Vertretung.
Ist eine “Scheidung Online” schneller?
Nein. Das gerichtliche Verfahren über den Antrag auf Scheidung wird dadurch nicht beschleunigt. Das Fertigen einer Antragsschrift für eine einvernehmliche Scheidung durch den Anwalt ist bei Vorliegen aller notwendigen Informationen ein Aufwand von wenigen Stunden, das gerichtliche Verfahren dauert demgegenüber ab der Einreichung der Scheidung mehrere Wochen bis Monate, bis die Berechnung der Rentenanwartschaften vorliegt und das Gericht einen Termin zur Scheidung bestimmt.
Durch die “Online Scheidung” gibt es keine “Blitzscheidung” für Sie und beschleunigen Sie das Scheidungsverfahren nicht, Sie sparen sich jedoch einmal den Weg zum Anwalt. Dadurch haben Sie aber normalerweise keinen Vorteil, denn Sie erhalten im Rahmen einer “Online Scheidung” nur bedingt eine individuelle Beratung, wodurch zusätzliche Rückfragen wahrscheinlich werden.
Ist eine “Online Scheidung” einfacher oder bequemer?
Für den Anwalt ist das so. Denn die Fragen, die Sie online im Rahmen eines Fragenkataloges beanworten, hat Ihnen sonst der Anwalt oder dessen Mitarbeiter zu stellen. Er spart sich die Zeit eines Beratungsgespräches und er spart sich Ihre persönlichen Rückfragen im Gespräch und damit die individuelle Beratung und den damit verbundenen Zeitaufwand.
Man könnte auch sagen, er hat einen Teil seiner Arbeit auf Sie übertragen.
Für Sie mag es einfach und bequem klingen, vom PC aus einen Auftrag für eine Scheidung zu erteilen und zahlreiche Fragen zu beantworten. Aber tatsächlich verzichten Sie auf einen erheblichen Teil der von dem Anwalt zu erbringenden Beratungsleistung, ohne dadurch einen geldwerten Vorteil zu haben aber Nachteile zu riskieren.
Sollten Sie in der Bewegungsfähigkeit erheblich eingeschränkt sein, brauchen Sie nicht auf eine Beratung zu verzichten, bitten Sie einen Anwalt, das Beratungsgespräch bei Ihnen zu Hause durchzuführen.
Kostet mich eine “Scheidung Online” weniger als eine normale einverständliche Scheidung?
Die Kosten einer “Scheidung Online” unterscheiden sich nicht von den gesetzlichen Kosten einer herkömmlichen Beauftragung von einem Anwalt. Die für Sie anfallenden Kosten sind von dem Streitwert des Verfahrens abhängig, dieser wird von dem Gericht festgelegt. Dabei spielt es keine Rolle, ob Sie den Anwalt online beauftragt haben. Die in dem Scheidungsverfahren mindestens anfallenden Gebühren für den Anwalt sind gesetzlich geregelt. Sie müssen also nur aufpassen, daß keine von den gesetzlichen Gebühren abweichende Honorarvereinbarung getroffen wird, um höhere als die gesetzlichen Kosten zu vermeiden.
Man kann sagen, daß Sie für gleiches Geld bei einer “Onlinescheidung ” weniger Leistung erhalten.
Die gesetzlichen Kosten sehen jedoch auch einen Ausgleich für Reisekosten vor. Die gesetzlichen Kosten für einen Anwalt oder für das Scheidungsverfahren werden also dann höher, wenn die Kanzlei selbst nicht am Ort des zuständigen Gerichts liegt. Unter Kostengesichtspunkten sollten Sie deshalb entweder eine Kanzlei beauftragen, die in Ihrer Nähe liegt oder für Sie günstig erreichbar ist oder nah am zuständigen Gericht liegt. Das wird bei einer “Online Scheidung” eher selten der Fall sein.
Muß ich oder der Anwalt bei einer “Scheidung Online” vor Gericht?
Ja. Wie gesagt ändert die Beauftragung online nichts an dem gerichtlich durchzuführendem Verfahren. Dieses sieht eine persönliche Anhörung der Parteien, also auch von Ihnen vor. Außerdem ist Voraussetzung für eine Scheidung, daß der Antragsteller anwaltlich vertreten ist, also auch im Termin zur mündlichen Verhandlung ein Anwalt für den Antragsteller anwesend ist.
Sie können sich das Erscheinen vor Gericht und ein Zusammentreffen mit dem Anwalt also nicht ersparen, auch wenn Begriffe wie “Scheidung Online” oder “Onlinescheidung” bzw. “Internetscheidung” etwas anderes suggerieren.
Was spricht gegen eine “Scheidung Online”?
Ein Antrag auf Ehescheidung sollte kein Schnellschuß sein, den man mal so eben online erledigt:
Eine Scheidung ist oft emotional ein tiefgreifender Eingriff, aber sie hat auch erhebliche juristische Folgen, bedarf bestimmter Voraussetzungen und für die Folgen kann es sogar darauf ankommen, wann Sie eine Scheidung einreichen. Können Sie sich diese Fragen wirklich selbst vorab beantworten, bevor Sie eine Scheidung online in Auftrag geben? Wollen Sie sich wirklich einem Ihnen völlig unbekanntem Anwalt nur per email (oder allenfalls telefonisch) anvertrauen, wenn Sie doch noch weitere Fragen haben und im Laufe des Verfahrens rechtliche Probleme mit dem Ehegatten auftauchen? Wenn Sie dann beim ersten Kontakt merken, daß Sie mit diesem Anwalt nicht zusammenarbeiten können, bleibt zwar ein Anwaltswechsel möglich, aber die Kosten sind ungleich höher als vor der Einreichung des Antrages auf Scheidung durch den Anwalt.
Der fehlende persönliche Kontakt und damit die bleibende Hemmschwelle zur Kontaktaufnahme im Fall von zusätzlichem Beratungsbedarf spricht gegen eine “Scheidung Online”. Auch merken Sie in einem persönlichen Erstgespräch (also bevor Sie den Auftrag zur Einreichung einer Scheidung geben) besser, ob Sie von dem Anwalt vor Ihnen wirklich im Rahmen einer eventuell doch noch streitig werdenden Scheidung wirklich vertreten werden wollen.
In einem ersten persönlichen Gespräch zwischen Anwalt und Mandant sind die notwendigen Hintergrundinformationen für den Anwalt viel besser zu erfragen und der Mandant kann im Fall von verbliebenen Unklarheiten selbst und unmittelbar nachfragen. Bei so einer Beratung kann sogar der Ehepartner dabei sein, diesem muß nur bewußt sein, daß der Anwalt nicht ihn vertritt. Auch kann wesentlich besser abgeklärt werden, ob eine Scheidung (z.B. wegen einer bevorstehenden Gesetzesänderung) besser bis zu einem bestimmten Zeitpunkt oder besser erst ab einem bestimmten Zeitpunkt eingereicht werden sollte.
Die persönliche Beratung bringt also schneller Klarheit für Anwalt und Mandant.
Scheidungsverfahren können einvernehmlich beginnen, aber Sie können mit Ihrem Ehegatten noch in Streit geraten. Spätestens dann benötigen Sie die individuelle Beratung durch einen Anwalt. Die Kanzlei sollte dann für Sie gut erreichbar sein.
Bei einer “Online Scheidung” beauftragen Sie online eine Ihnen unbekannte Kanzlei, die mit einer gewissen Wahrscheinlichkeit weder in Ihrer noch in der Nähe des zuständigen Gerichts sitzt, sondern irgendwo in Deutschland liegt. Zum Gerichtstermin muß der beauftragte Anwalt entweder persönlich und möglicherweise aus großer Entfernung anreisen oder er wird einen Anwalt vor Ort beauftragen. In diesen Fällen entstehen Ihnen zusätzliche Kosten, was bei einer “Online Scheidung” leichter übersehen wird.
Zusammengefaßt kann man sagen: Sie erhalten bei einer Online Scheidung sehr wahrscheinlich weniger Leistung bei gleichen Kosten und ohne sonstigen erkennbaren Mehrwert!

I’ll gear this review to 2 types of people: current Zune owners who are considering an upgrade, and people trying to decide between a Zune and an iPod. (There are other players worth considering out there, like the Sony Walkman X, but I hope this gives you enough info to make an informed decision of the Zune vs players other than the iPod line as well.)

The Zune concentrates on being a Portable Media Player. Not a web browser. Not a game machine. Maybe in the future it’ll do even better in those areas, but for now it’s a fantastic way to organize and listen to your music and videos, and is without peer in that regard. The iPod’s strengths are its web browsing and apps. If those sound more compelling, perhaps it is your best choice.

This is getting a bit more subjective, but I much prefer the Zune Marketplace. The interface is colorful, has more flair, and some cool features like ‘Mixview’ that let you quickly see related albums, songs, or other users related to what you’re listening to. Clicking on one of those will center on that item, and another set of “neighbors” will come into view, allowing you to navigate around exploring by similar artists, songs, or users. Speaking of users, the Zune “Social” is also great fun, letting you find others with shared tastes and becoming friends with them. You then can listen to a playlist created based on an amalgamation of what all your friends are listening to, which is also enjoyable. Those concerned with privacy will be relieved to know you can prevent the public from seeing your personal listening habits if you so choose.

Hands down, Apple’s app store wins by a mile. It’s a huge selection of all sorts of apps vs a rather sad selection of a handful for Zune. Microsoft has plans, especially in the realm of games, but I’m not sure I’d want to bet on the future if this aspect is important to you. The iPod is a much better choice in that case.

The new Zune browser is surprisingly good, but not as good as the iPod’s. It works well, but isn’t as fast as Safari, and has a clunkier interface. If you occasionally plan on using the web browser that’s not an issue, but if you’re planning to browse the web alot from your PMP then the iPod’s larger screen and better browser may be important.
