Die elterliche Sorge (Sorgerecht) und das Übereinkommen über die Rechte von Menschen mit Behinderungen (UN-Behindertenkonvention)
Das Übereinkommen über die Rechte von Menschen mit Behinderungen ist seit März 2009 in Kraft
Nach dem Inkrafttreten des entsprechenden Ratifikationsgesetzes zum 01. 01.09 wurde von Deutschland laut dem Bundesministerium für Arbeit und Soziales am 24.02.09 die Ratifikationsurkunde zum Übereinkommen über die Rechte von Menschen mit Behinderungen und zum Fakultativprotokoll im Hauptquartier der Vereinten Nationen in New York hinterlegt. Damit wurden beide völkerrechtlichen Verträge nach Ablauf von 30 Tagen am 26.03.09 für Deutschland verbindlich (vergleiche Artikel 45).
Zweck dieses Übereinkommens ist es, den vollen und gleichberechtigten Genuss aller Menschenrechte und Grundfreiheiten durch alle Menschen mit Behinderungen zu fördern, zu schützen und zu gewährleisten und die Achtung der ihnen innewohnenden Würde zu fördern. Zu den Menschen mit Behinderungen zählen Menschen, die langfristige körperliche, seelische, geistige oder Sinnesbeeinträchtigungen haben, welche sie in Wechselwirkung mit verschiedenen Barrieren an der vollen, wirksamen und gleichberechtigten Teilhabe an der Gesellschaft hindern können (vergleiche Artikel 1 des Übereinkommens).
Was hat diese Konvention mit der elterlichen Sorge (Sorgerecht) zu tun?
Nach meiner beruflichen Erfahrung gibt es eine Tendenz von Seiten der staatlichen Einrichtungen, mit Verweis auf die Kosten oder angeblich fehlender Verfügbarkeit besserer Maßnahmen solche Hilfen anzubieten, die im Alltag nicht ausreichen oder sogar von vornherein eine Trennung von Eltern und Kind bedeuten. Wenn die Eltern diese Angebote nicht annehmen, kann ihnen das den Vorwurf einbringen, nicht das Wohl des Kindes, sondern die eigenen Interessen in den Vordergrund zu stellen.
Die Konvention stärkt die Rechte von Behinderten. Der Begriff einer Behinderung im Sinne der Konvention wird nach mir bisher bekannter Auffassung weit ausgelegt.
In Artikel 23 (Achtung der Wohnung und der Familie) wird ausgeführt:

(4) Die Vertragsstaaten gewährleisten, dass ein Kind nicht gegen den Willen seiner Eltern von diesen getrennt wird, es sei denn, dass die zuständigen Behörden in einer gerichtlich nachprüfbaren Entscheidung nach den anzuwendenden Rechtsvorschriften und Verfahren bestimmen, dass diese Trennung zum Wohl des Kindes notwendig ist. In keinem Fall darf das Kind aufgrund einer Behinderung entweder des Kindes oder eines oder beider Elternteile von den Eltern getrennt werden.
(5) Die Vertragsstaaten verpflichten sich, in Fällen, in denen die nächsten Familienangehörigen nicht in der Lage sind, für ein Kind mit Behinderungen zu sorgen, alle Anstrengungen zu unternehmen, um andere Formen der Betreuung innerhalb der weiteren Familie und, falls dies nicht möglich ist, innerhalb der Gemeinschaft in einem familienähnlichen Umfeld zu gewährleisten.

Die Formulierung in Ziffer (4) stellt darauf ab, daß die Trennung zum Wohl des Kindes notwendig ist. Hier sehe ich Potential zu Gunsten der Betroffenen, da nicht mehr auf eine bloße Gefährdung abzustellen ist.
Nach Ziffer (5) ist klar vorrangig vor einer Herausnahme eine Verpflichtung des Staates, die Betreuung in der weiteren Familie zu ermöglichen. Damit dürften erhebliche staatliche Verpflichtungen zur Unterstützungsleistung begründet sein, die Unterbringung in Heimen wäre danach das letzte Mittel der Wahl.
Es ist deshalb in jedem Fall empfehlenswert, im Einzelfall zu prüfen, inwieweit durch die Konvention dem Staat nicht eine (in der Regel für das Jugendamt einfacher zu praktizierende) Herausnahme versagt bleibt.

Hands down, Apple’s app store wins by a mile. It’s a huge selection of all sorts of apps vs a rather sad selection of a handful for Zune. Microsoft has plans, especially in the realm of games, but I’m not sure I’d want to bet on the future if this aspect is important to you. The iPod is a much better choice in that case.

Between me and my husband we’ve owned more MP3 players over the years than I can count, including Sansas, iRivers, iPods (classic & touch), the Ibiza Rhapsody, etc. But, the last few years I’ve settled down to one line of players. Why? Because I was happy to discover how well-designed and fun to use the underappreciated (and widely mocked) Zunes are.

This is getting a bit more subjective, but I much prefer the Zune Marketplace. The interface is colorful, has more flair, and some cool features like ‘Mixview’ that let you quickly see related albums, songs, or other users related to what you’re listening to. Clicking on one of those will center on that item, and another set of “neighbors” will come into view, allowing you to navigate around exploring by similar artists, songs, or users. Speaking of users, the Zune “Social” is also great fun, letting you find others with shared tastes and becoming friends with them. You then can listen to a playlist created based on an amalgamation of what all your friends are listening to, which is also enjoyable. Those concerned with privacy will be relieved to know you can prevent the public from seeing your personal listening habits if you so choose.

Zune and iPod: Most people compare the Zune to the Touch, but after seeing how slim and surprisingly small and light it is, I consider it to be a rather unique hybrid that combines qualities of both the Touch and the Nano. Apple now has Rhapsody as an app, which is a great start, but it is currently hampered by the inability to store locally on your iPod, and has a dismal 64kbps bit rate. If this changes, then it will somewhat negate this advantage for the Zune, but the 10 songs per month will still be a big plus in Zune Pass’ favor.
