DER GERICHTSHOF BEKRÄFTIGT DAS VERBOT DER DISKRIMINIERUNG WEGEN DES ALTERS UND DIE ROLLE DER NATIONALEN GERICHTE BEI SEINER ANWENDUNG
Die deutsche Regelung, nach der vor Vollendung des 25. Lebensjahrs liegende Beschäftigungszeiten des Arbeitnehmers bei der Berechnung der Kündigungsfrist nicht berücksichtigt werden, verstößt gegen das Verbot der Diskriminierung wegen des Alters in seiner Konkretisierung durch die Richtlinie 2000/78 und ist vom nationalen Gericht auch in einem Rechtsstreit zwischen Privaten erforderlichenfalls unangewendet zu lassen.In seinem Urteil Mangold aus dem Jahr 2005(1) hat der Gerichtshof anerkannt, dass ein Verbot der Diskriminierung wegen des Alters besteht, das als ein allgemeiner Grundsatz des Unionsrechts anzusehen ist. Die Richtlinie 2000/78 über die Verwirklichung der Gleichbehandlung in Beschäftigung und Beruf(2) konkretisiert diesen Grundsatz. Diese Richtlinie verbietet die Diskriminierung wegen des Alters, gestattet aber dem nationalen Gesetzgeber, vorzusehen, dass eine Ungleichbehandlung, obwohl sie auf dem Alter beruht, in bestimmten Fällen keine Diskriminierung und somit nicht verboten ist. Eine Ungleichbehandlung wegen des Alters ist u. a. dann zulässig, wenn sie durch ein legitimes Ziel aus den Bereichen Beschäftigungspolitik, Arbeitsmarkt und berufliche Bildung gerechtfertigt ist und die Mittel zur Erreichung dieses Ziels angemessen und erforderlich sind. Auch die Charta der Grundrechte der Europäischen Union, die seit Inkrafttreten des Vertrags von Lissabon den gleichen rechtlichen Rang wie die Verträge hat, verbietet Diskriminierungen wegen des Alters(3).
Nach deutschem Arbeitsrecht verlängern sich die vom Arbeitgeber einzuhaltenden Kündigungsfristen stufenweise mit zunehmender Dauer des Arbeitsverhältnisses. Vor der Vollendung des 25. Lebensjahrs des Arbeitnehmers liegende Beschäftigungszeiten werden bei der Berechnung jedoch nicht berücksichtigt.
Frau Kücükdeveci war seit ihrem vollendeten 18. Lebensjahr bei dem Unternehmen Swedex beschäftigt. Im Alter von 28 Jahren wurde sie unter Einhaltung einer Kündigungsfrist von einem Monat entlassen. Der Arbeitgeber berechnete die Kündigungsfrist unter Zugrundelegung einer Beschäftigungsdauer von drei Jahren, obwohl die Arbeitnehmerin seit zehn Jahren bei ihm beschäftigt war. Wie in den deutschen Rechtsvorschriften vorgesehen, hatte er die vor der Vollendung des 25. Lebensjahrs liegenden Beschäftigungszeiten von Frau Kücükdeveci bei der Berechnung der Kündigungsfrist nicht berücksichtigt. Frau Kücükdeveci klagte gegen ihre Entlassung und machte geltend, dass diese Regelung eine unionsrechtlich verbotene Diskriminierung wegen des Alters darstelle. Die Kündigungsfrist hätte 4 Monate betragen müssen, was einer Betriebszugehörigkeit von 10 Jahren entspreche.
Das als Berufungsgericht angerufene Landesarbeitsgericht Düsseldorf hat den Gerichtshof zur Vereinbarkeit einer solchen Kündigungsregelung mit dem Unionsrecht und zu den Folgen einer etwaigen Unvereinbarkeit befragt.

Der Gerichtshof prüft diese Fragen auf der Grundlage des jede Diskriminierung wegen des Alters verbietenden allgemeinen Grundsatzes des Unionsrechts, wie er in der Richtlinie 2000/78 konkretisiert ist. Da Frau Kücükdeveci nach dem Zeitpunkt entlassen worden war, bis zu dem die Bundesrepublik Deutschland die Richtlinie 2000/78 in innerstaatliches Recht umzusetzen hatte, bewirkte diese Richtlinie nämlich, dass die deutsche Kündigungsregelung in den Anwendungsbereich des Unionsrechts fällt.
Der Gerichtshof stellt fest, dass diese Kündigungsregelung eine Ungleichbehandlung enthält, die auf dem Kriterium des Alters beruht. Diese Regelung sieht eine weniger günstige Behandlung für Arbeitnehmer vor, die ihre Beschäftigung bei dem Arbeitgeber vor Vollendung des 25. Lebensjahrs aufgenommen haben. Sie behandelt somit Personen, die die gleiche Betriebszugehörigkeitsdauer aufweisen, unterschiedlich, je nachdem, in welchem Alter sie in den Betrieb eingetreten sind.
Obwohl die Ziele dieser Kündigungsregelung zur Beschäftigungs- und Arbeitsmarktpolitik gehören und daher legitim sind, ist die Regelung zur Erreichung dieser Ziele nicht angemessen oder geeignet.
Zu dem vom nationalen Gericht angeführten Ziel, dem Arbeitgeber eine größere personalwirtschaftliche Flexibilität zu verschaffen, indem seine Belastung im Zusammenhang mit der Entlassung jüngerer Arbeitnehmer verringert werde, denen eine größere berufliche und persönliche Mobilität zugemutet werden könne, stellt der Gerichtshof fest, dass die fragliche Regelung keine im Hinblick auf die Erreichung dieses Zieles angemessene Maßnahme ist, weil sie für alle Arbeitnehmer, die vor Vollendung des 25. Lebensjahrs in den Betrieb eingetreten sind, unabhängig davon gilt, wie alt sie zum Zeitpunkt ihrer Entlassung sind.
Der Gerichtshof gelangt daher zu dem Ergebnis, dass das Unionsrecht, insbesondere das Verbot der Diskriminierung wegen des Alters in seiner Konkretisierung durch die Richtlinie 2000/78, einer nationalen Regelung wie der deutschen entgegensteht, nach der vor Vollendung des 25. Lebensjahrs liegende Beschäftigungszeiten des Arbeitnehmers bei der Berechnung der Kündigungsfrist nicht berücksichtigt werden.
Der Gerichtshof erinnert sodann daran, dass eine Richtlinie nicht selbst Verpflichtungen für einen Einzelnen begründen kann, so dass ihm gegenüber eine Berufung auf die Richtlinie als solche nicht möglich ist. Der Grundsatz der Gleichbehandlung in Beschäftigung und Beruf wird in der Richtlinie 2000/78 jedoch nur konkretisiert. Zudem ist das Verbot der Diskriminierung wegen des Alters ein allgemeiner Grundsatz des Unionsrechts. Es obliegt daher dem nationalen Gericht, bei dem ein Rechtsstreit über das Verbot der Diskriminierung wegen des Alters in seiner Konkretisierung durch die Richtlinie 2000/78 anhängig ist, im Rahmen seiner Zuständigkeiten den rechtlichen Schutz, der sich für den Einzelnen aus dem Unionsrecht ergibt, sicherzustellen und die volle Wirksamkeit des Unionsrechts zu gewährleisten, indem es erforderlichenfalls jede diesem Verbot entgegenstehende Bestimmung des nationalen Rechts unangewendet lässt.
Nachdem er auf die Möglichkeit für das nationale Gericht hingewiesen hat, den Gerichtshof im Wege der Vorabentscheidung um Auslegung des Unionsrechts zu ersuchen, stellt der Gerichtshof abschließend fest, dass es dem nationalen Gericht obliegt, in einem Rechtsstreit zwischen Privaten die Beachtung des Verbots der Diskriminierung wegen des Alters in seiner Konkretisierung durch die Richtlinie 2000/78 sicherzustellen, indem es erforderlichenfalls entgegenstehende Vorschriften des innerstaatlichen Rechts unangewendet lässt, unabhängig davon, ob es von seiner Befugnis Gebrauch macht, den Gerichtshof um eine Vorabentscheidung über die Auslegung dieses Verbots zu ersuchen.

HINWEIS: Im Wege eines Vorabentscheidungsersuchens können die Gerichte der Mitgliedstaaten in einem bei ihnen anhängigen Rechtsstreit dem Gerichtshof Fragen nach der Auslegung des Unionsrechts oder nach der Gültigkeit einer Handlung der Union vorlegen. Der Gerichtshof entscheidet nicht über den nationalen Rechtsstreit. Es ist Sache des nationalen Gerichts, über die Rechtssache im Einklang mit der Entscheidung des Gerichtshofs zu entscheiden. Diese Entscheidung bindet in gleicher Weise andere nationale Gerichte, die mit einem ähnlichen Problem befasst werden.
