PM OLG Brandenburg vom 21.02.2012 – 10 UF 253/11 – Unbefristeter Unterhaltsanspruch bei über 30-jähriger Ehe wegen ehebedingter Nachteile bejaht
Seit der Reform des Unterhaltsrechts zum 1.1.2008 gilt im Bereich des Geschiedenenunterhalts der Grundsatz der Eigenverantwortung. Allerdings hat der geringer verdienende geschiedene Ehegatte einen Unterhaltsanspruch, wenn er mit seinen Einkünften den bisherigen Lebensstandard nicht aufrechterhalten kann. Das ist der sogenannte Aufstockungsunterhalt. Die Höhe berechnet sich nach der Differenzmethode.
Dabei erhält der weniger verdienende geschiedene Ehegatte 3/7 des Unterschiedbetrages zwischen den monatlichen Einkünften als Unterhalt.
Die heute 50jährige Ehefrau brach im Alter von 17 Jahren ihre Ausbildung zur Gärtnerin ab, weil das erste gemeinsame Kind geboren wurde. Nach der Eheschließung holte sie bis heute keine Berufsausbildung mit einem Berufsabschluss nach. Sie betreute vielmehr die beiden Kinder, übte verschiedene Nebentätigkeiten aus und absolvierte einige Weiterbildungsveranstaltungen. Derzeit kann sie monatlich 1.000 € verdienen. Der Ehemann ist vollschichtig als Kraftfahrer tätig und verdient rund 1.500 € monatlich.
Das Amtsgericht hat die Ehe, die über 30 Jahre hielt, geschieden und den Versorgungsausgleich durchgeführt. Außerdem hat es der Ehefrau monatlich zu zahlenden nachehelichen Unterhalt zugesprochen. Gegen die Verpflichtung zur Unterhaltszahlung hat sich der Ehemann mit seiner Beschwerde gewendet. Er will keinen Unterhalt zahlen bzw. seine Verpflichtung auf einen angemessenen Zeitraum befristen. Er trägt vor, seine geschiedene Ehefrau wäre auch ohne die Ehe ohne Berufsabschluss geblieben.
Der zuständige zweite Familiensenat des Oberlandesgerichts hat die Entscheidung des Amtsgerichts im Grundsatz bestätigt. Zur Begründung hat das Oberlandesgericht ausgeführt, es gebe keine Anhaltspunkte dafür, dass die Ehefrau ohne die Ehe, die Kinderbetreuung und die in der Ehe praktizierte Rollenverteilung auch heute ungelernten Tätigkeiten nachgehen würde. Die Ehefrau habe sich bereits ein Jahr in der Berufsausbildung befunden und hätte sie
nach allgemeiner Erfahrung auch abgeschlossen. Es sei davon auszugehen, dass sie als Landschaftsgärtnerin jedenfalls ein ähnlich hohes Einkommen wie ihr Ehemann hätte erzielen können. Der Ehemann müsse den in dem Einkommensunterschied liegenden ehebedingten Nachteil deshalb angesichts der über 30jährigen Dauer der Ehe unbefristet und ohne Abzüge ausgleichen.
Das Oberlandesgericht hat die Rechtsbeschwerde zum Bundesgerichtshof nicht zugelassen.
